Telford restaurant fined for selling “fake” Malibu

Tin Tin Cantonese restaurant in Donnington was fined £4,000 and ordered to pay £1,420 costs plus a £15 victim surcharge.

Company secretary Henry Lui was fined £400 and also ordered to pay the £15 victim surcharge.

They had both pleaded guilty to two charges each under the Consumer Protection from Unfair Trading Regulations 2008 and two charges under the Trade Marks Act 1994.

Telford Magistrates Court heard yesterday that a complaint was made to Telford & Wrekin Council’s trading standards team, claiming that Tin Tin Cantoneses restaurant was substituting Malibu for a cheaper alternative but passing it off as the genuine brand.

Following the complaint, officers visited the restaurant and took formal samples of both Malibu and Smirnoff.

These were sent to the Public Analyst who confirmed that both samples were not the genuine brand.
